1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed by consumers via the evior online shop.
evior's offers are directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB).

Shipping is currently exclusively to Germany, Austria, Belgium, Luxembourg, the Netherlands, France, Italy, and Spain.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an unbinding invitation to order.
By clicking the "Buy Now" or "Order with Obligation to Pay" button, the customer submits a binding offer to purchase the goods in the shopping cart.
The purchase contract is only concluded by our order confirmation via email or by shipping the goods.

3. Prices and Payment Terms

All prices stated are in Euro (€) and include the statutory value-added tax as well as all other price components.
Any applicable shipping costs are shown separately during the ordering process and on the "Shipping & Delivery" page.

4. Delivery and Shipping

Shipping is currently to:

Shipping will be to the delivery address provided by the customer.

Delivery time is usually:

• Germany: 2–4 business days
• Austria, Belgium, Luxembourg, and Netherlands: 3–7 business days
• France, Italy, and Spain: 4–10 business days

The delivery times stated on the "Shipping & Delivery" page are authoritative.

Should delivery be delayed exceptionally or a product not be available, we will inform the customer immediately.

5. Product Characteristics

evior's jewelry pieces are crafted with great care.
Pearls and other natural materials are natural products. Differences in shape, size, color, luster, or surface structure are natural characteristics and do not constitute a defect.
Product images are for illustration purposes. Minor deviations between the displayed and delivered products are possible.
Each piece of jewelry is unique due to the natural materials used.
evior's gold-plated jewelry pieces are made from high-quality sterling silver and finished with a high-quality 18-carat gold vermeil plating.

Gold vermeil refers to a particularly high-quality form of gold plating on a precious metal base. Despite the high quality, gilding involves wear layers whose natural abrasion due to wearing, environmental influences, and care behavior does not constitute a defect.

6. Personalized Jewelry

Special conditions apply to individually made or personalized jewelry.
Personalized products include, in particular, jewelry pieces that are manufactured, modified, or designed according to individual customer wishes.
For such products, there is no right of withdrawal, provided that the legal requirements according to Section 312g (2) BGB are met.
The exclusion of the right of withdrawal will be separately indicated to the customer before placing the order.

7. Right of Withdrawal and Returns

Consumers have the statutory right of withdrawal. Details can be found in the separate withdrawal instructions.
The customer bears the direct costs of returning the goods.
Before each return, the return form provided on the website must be filled out completely.
Returns must be adequately insured and sent with tracking to the specified return address.
The customer is liable for loss or damage during return transport if the return was not sufficiently insured.

8. Retention of Title

The delivered goods remain the property of evior until full payment.

9. Warranty

The statutory warranty rights of the Federal Republic of Germany apply.
The statutory warranty rights remain unaffected. No warranty is provided for damages caused by improper handling, inadequate care, normal wear and tear, or external influences.
Normal signs of use do not constitute a defect.

10. Care Instructions

To preserve the beauty and longevity of the jewelry, evior recommends:

• Protecting jewelry from contact with aggressive chemicals.
• Removing jewelry before heavy mechanical stress.
• Storing jewelry dry and protected.
• Cleaning jewelry regularly with a soft cloth.
• Removing jewelry before showering, bathing, or swimming.
• Avoiding contact with perfume, cosmetics, and cleaning agents.

11. Product Safety

evior's jewelry pieces are intended exclusively as jewelry and are not suitable as toys.
Jewelry should be kept out of reach of small children.
In case of allergic reactions or intolerances, wearing the jewelry should be stopped immediately.

12. Liability

Evior is fully liable for intent and gross negligence.

In case of slight negligence in breaching essential contractual obligations, liability is limited to the foreseeable damages typical for the contract.
The aforementioned limitations of liability do not apply to injuries to life, body, or health.

13. Dispute Resolution

The European Commission provides a platform for online dispute resolution:

Evior is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
